This Privacy Policy explains what information we collect, how we use it, and what choices you have. It applies to all users of the CHIPS platform at getchips.ai and to the CHIPS Platform Notifications text messaging program.

This is the only privacy policy for CHIPS. It is published at getchips.ai/privacy. Where this same policy appears elsewhere on getchips.ai, it is the identical document rendered from one source – there is no second or alternate CHIPS privacy policy.

Summary of our position on mobile data: we do not sell your personal information, and no mobile information is ever shared with third parties or affiliates for marketing or promotional purposes.

1. Information We Collect

Information You Provide – Account information (name, email, mobile phone number, credentials); profile information (professional details, work samples, skills for creators); payment information processed through Stripe (we do not store your full credit card number); contract content (briefs, deliverables, feedback, ratings, communications); your text messaging opt-in status and consent record; and support communications. Information Collected Automatically – usage data, device and browser data, analytics data (via Statsig: usage events, feature flag evaluations, and performance metrics, tied to your account identifier and email address); session replay recordings of your on-screen activity within the Platform, which may include contract content displayed to you; and server log data.

2. How We Use Your Information

We use your information to operate and maintain the Platform (escrow, reputation, matching); process payments and token transactions; personalize your experience including AI features like Chippy; communicate about your account, contracts, and updates (by email, in the Platform, and by text message if you opted in); analyze usage to improve the Platform; prevent fraud and enforce our Terms; and comply with legal obligations. We use your mobile phone number only to deliver the account and contract notifications described in Section 4 and to verify your identity for security. We do not use your mobile phone number for marketing, and we do not sell your personal information.

3. Third-Party Services and Sharing

We share information with service providers who process data on our behalf: Supabase (database, auth, backend), Stripe (payments), Statsig (analytics and session replay), Anthropic/Google/OpenAI/Lambda (AI features), ElevenLabs (voice), and Twilio (SMS delivery). These providers act on our instructions, are contractually required to protect your data, and may use it only for the purposes we specify. We may also disclose information when required by law, to protect our rights or the safety of others, or in connection with a merger, acquisition, or sale of assets.

Mobile information carve-out. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the above categories of sharing exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. We do not sell, rent, trade, or lease mobile phone numbers or SMS consent records to anyone, for any purpose. Twilio receives your phone number solely to transmit the messages you requested. Consent you give to CHIPS is not transferable and will not be passed to any other company, including our affiliates and marketing partners, in a merger, acquisition, sale of assets, or any other transaction.

4. SMS and Mobile Information

These are the terms of our text messaging program. They are identical to Section 11 of our Terms of Service and to the standalone page at getchips.ai/sms-terms.

Program Name: CHIPS Platform Notifications.

What you receive. By providing your mobile phone number and opting in, you consent to receive transactional and informational text messages from CHIPS about your account activity – contract status updates, escrow notifications, delivery alerts, review reminders, and security verifications. We do not send marketing or promotional text messages through this program.

How you opt in. Opt-in is express and always affirmative. You enter and verify your mobile number in your CHIPS account settings, and the consent box appears on that same screen with the number being enrolled displayed beside it. The box starts unchecked and reads: "I agree to receive account and contract notification text messages from CHIPS at (your mobile number): contract status updates, delivery and revision alerts, deadline and review reminders, and security verification codes. Message frequency varies. Message and data rates may apply. Reply STOP to cancel, HELP for help. See our Terms and Conditions and Privacy Policy." We never add a number to the program from a purchased, rented, or third-party list, and we never share opt-in consent obtained by CHIPS with anyone else.

Consent is not a condition of purchase. You do not have to agree to receive text messages in order to create a CHIPS account, post a contract, claim a contract, or get paid. If you opt out or never opt in, you still receive every notification by email and in the Platform interface.

Message frequency. Frequency varies with your Platform activity – you receive messages only when something happens on a contract you are part of.

Cost. Message and data rates may apply. CHIPS does not charge you for text messages; your mobile carrier's standard rates apply.

Opting out. Reply STOP to any message to cancel. You will receive a single confirmation message and then no further texts. Reply HELP to any message, or email help@getchips.ai, for assistance.

Carrier notice. Mobile carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed on every carrier or handset.

Mobile information is never shared for marketing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the sharing described in our Privacy Policy excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties. Twilio, our messaging provider, receives your phone number solely to transmit the messages you requested and is contractually prohibited from using it for any other purpose.

5. Cookies and Tracking

We use cookies and similar technologies for authentication, security, preferences, and analytics. You can manage cookie preferences through your browser settings. We do not use third-party advertising trackers, and we do not serve ads on the Platform.

6. Data Retention

We retain your account and contract data for as long as your account is active, plus a reasonable period afterward to comply with legal obligations, resolve disputes, and enforce our Terms. We retain your text messaging consent and opt-out records for as long as required to demonstrate compliance with messaging law, and no longer. If you close your account, we will delete or anonymize your personal data within 90 days, except where we are legally required to retain it.

7. Your Rights

All users may request access, correction, deletion, and portability of their personal data. California residents (CCPA/CPRA) additionally have the right to know what we collect, to opt out of sale/sharing (we do not sell personal information and we do not share it for cross-context behavioral advertising), and to non-discrimination. EU/UK/EEA residents (GDPR) have rights to restrict and object to processing, withdraw consent, and lodge a complaint with a supervisory authority; we rely on Standard Contractual Clauses for data transfers to the United States. To exercise any right, contact help@getchips.ai. To withdraw text messaging consent specifically, reply STOP to any message – no email required.

8. Children

The Platform is not intended for anyone under 18. We do not knowingly collect personal information from anyone under 18. If you believe we have collected data from a minor, contact us at help@getchips.ai and we will delete it promptly.

9. Security

We implement reasonable technical and organizational measures to protect your data, including encryption in transit and at rest, access controls, and regular security reviews. However, no system is perfectly secure – we cannot guarantee absolute security.

10. International Transfers

The Platform is operated from the United States. If you access it from outside the U.S., your data will be transferred to and processed in the United States. For EU/UK/EEA users, we use Standard Contractual Clauses to protect your data during these transfers.

11. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or through the Platform at least 30 days before the changes take effect. We will not apply a material change retroactively to mobile information collected under an earlier version of this policy.

12. Scope of This Policy

This Privacy Policy is the sole and controlling privacy policy for getchips.ai, the CHIPS platform, and the CHIPS Platform Notifications messaging program. No other policy governs information collected through CHIPS. Consent you give to the CHIPS messaging program applies only to CHIPS: it is not shared with, transferred to, or relied upon by any other company, brand, affiliate, or messaging program.
